This Privacy Policy for Sellers ("Seller Privacy Policy") governs the collection, use, disclosure, and protection of personal data provided by you ("you" or "Seller") in connection with your use of the Seller Dashboard at https://board.realcapital.ie/ ("Seller Dashboard") and your participation as a Seller on the RealCapital Marketplace ("Marketplace"). This Seller Privacy Policy supplements the general Privacy Policy applicable to all users of the RealCapital websites ("Site") and is incorporated into the Terms of Service for Sellers ("Seller Terms") by reference. RealCapital, the entity operating the Seller Dashboard and Marketplace, is referred to herein as "we," "us," or "our."
By registering an account on the Seller Dashboard and using our services, you acknowledge that you have read, understood, and agree to the practices described in this Seller Privacy Policy. If you do not agree, you must not register an account or use the Seller Dashboard.
We reserve the right to update this Seller Privacy Policy at our sole discretion. Changes will be indicated by updating the "Last Updated" date above, and your continued use of the Seller Dashboard constitutes acceptance of the revised policy. We collect personal data from Sellers to enable the functionality of the Seller Dashboard and Marketplace. The types of information we collect include:
When you create an account on the Seller Dashboard, we collect:
Google Authentication: If you register via Google, we receive your name, email address, and profile information from Google.
Email Registration: If you register directly, we collect your full name, email address, phone number, and any additional details you provide (e.g., agency name, address, or social links).
When you submit Property Listings, we collect:
Personal data included in listings, such as your name, email address, and phone number, which may be publicly displayed on the Marketplace.
Content you upload, including text descriptions, images, and YouTube video links related to properties.
When you purchase a Subscription:
We collect payment information (e.g., billing address) via third-party processors Stripe and PayPal. We do not store full credit card details; these are handled securely by our payment providers.
We automatically collect:
Technical data such as IP address, browser type, device information, and usage patterns when you interact with the Seller Dashboard.
Data cached globally via our Content Delivery Network (CDN) provider, Cloudflare, to optimize performance.
We use your personal data for the following purposes:
Account Management: To create, maintain, and secure your Seller account.
Property Listings: To display your listings on the Marketplace, including publishing your contact details for Buyers to reach you directly.
Payment Processing: To facilitate Subscription payments through Stripe and PayPal.
Service Delivery: To operate the Seller Dashboard, verify listings, and provide support.
Marketing and Promotion: To promote your listings on the Marketplace and related materials, pursuant to the license granted in the Seller Terms.
Analytics: To monitor usage, improve functionality, and enhance user experience.
Legal Compliance: To comply with applicable laws, such as data protection regulations (e.g., GDPR) and tax requirements.
We may disclose your personal data as follows:
Your name, email address, phone number, and agency details (if applicable) included in Property Listings are publicly displayed on the Marketplace to facilitate direct communication with Buyers.
We share your data with:
Search Engines: Google, Bing, Yahoo!, Yandex, DuckDuckGo, Baidu, Naver, and Seznam may index public listing data for search visibility.
Payment Processors: Stripe and PayPal process payment information for Subscriptions.
Cloudflare: Our CDN caches data globally to optimize Site performance.
Load Balancers: Data is routed through servers worldwide for efficient traffic management.
We may disclose your data to comply with legal requirements, respond to lawful requests from authorities, or protect our rights, property, or safety, as well as that of others.
Server Location: Our primary servers are located in Germany, and all personal data is initially stored there in compliance with GDPR.
Global Distribution: We use a Load Balancer to distribute traffic across continents and Cloudflare’s CDN, which caches data on servers worldwide. This may result in your data being transferred to and stored in countries outside the European Economic Area (EEA), including the United States and other jurisdictions with varying data protection laws.
Safeguards: Where data is transferred outside the EEA, we rely on Standard Contractual Clauses (SCCs) and other lawful mechanisms to ensure adequate protection, as required by GDPR.
Under applicable data protection laws (e.g., GDPR), you have the following rights:
Access: Request a copy of your personal data.
Rectification: Correct inaccurate or incomplete data.
Erasure: Request deletion of your account and associated data ("right to be forgotten").
Restriction: Limit how we process your data.

Via Dashboard: You may delete your account directly through the Seller Dashboard settings.
Via Email: Submit requests to [email protected]. We will respond within thirty (30) days, subject to verification of your identity.
Note: Deletion requests will remove your account and non-public data, but public listing data indexed by search engines may persist beyond our control.
Active Accounts: We retain your personal data for as long as your Seller account remains active and as needed to provide services.
Post-Termination: Upon account deletion or termination, we retain data for up to ninety (90) days for backup purposes, unless required longer by law (e.g., tax records). Publicly posted listing data may remain accessible via third-party search engines indefinitely.
We implement reasonable technical and organizational measures to protect your personal data from unauthorized access, loss, or alteration. These include encryption, secure authentication (e.g., Google OAuth), and compliance with Payment Card Industry Data Security Standards (PCI DSS) via Stripe and PayPal. However, no system is entirely secure, and we cannot guarantee absolute protection against all risks (e.g., cyberattacks).
